Việc “xuất khẩu → gửi kho ngoại quan → nhập khẩu trở lại” được phép và có khung pháp lý rõ ràng. Doanh nghiệp hoàn toàn có thể hưởng ưu đãi thuế NK ưu đãi đặc biệt nếu đáp ứng đầy đủ các quy định.
CAN GOODS SENT TO A FOREIGN - TRADE WAREHOUSE RECEIVE PREFERENTIAL DUTIES WHEN RE - IMPORTING?
Many enterprises face difficulties in determining eligibility for preferential tariff treatment under FTAs. The Customs Department confirms that a foreign-trade warehouse is a duty-free zone, and transactions between the duty - free area and the domestic market are considered import - export activities. Therefore, goods from a foreign - trade warehouse entering the domestic market, if meeting all regulations, are eligible for special preferential import duties.
Regarding the rules of direct transport under FTAs (pursuant to Circular 22/2016/TT - BCT and Circular 33/2023/TT - BTC), goods transported from abroad to a foreign - trade warehouse in Vietnam are still considered to be under direct transport.
For Vietnamese goods exported and sent to a foreign - trade warehouse and then re - imported, since the goods are not interfered with and remain under Customs supervision, they meet the direct transport requirement.
The process of “export → foreign-trade warehouse → re-import” is permitted and has a clear legal framework. Enterprises can fully enjoy special preferential import duties if they comply with all relevant regulations.

寄往保税仓库的货物再次进口能享受关税优惠吗？
许多企业在确定是否符合自由贸易协定 (FTA) 下的关税优惠条件时遇到困难. 海关部门确认,保税仓库属于免税区, 保税区与国内市场之间的交易被视为进出口活动. 因此, 来自保税仓库的货物进入国内市场, 只要符合相关规定, 即可享受特殊优惠进口关税.
